Dear Sir:
I request your investigation into a matter that has received no action from CAP senior management. A minor aircraft mishap occurred during RCC mission XXX, and a propeller was damaged during taxi operations at a local private airstrip while locating an ELT. I was not in the aircraft, but I have been significantly penalized.
Since Aug 10, 1990 1 have been grounded from all flight activities. The XXX Wing commander has ordered my removal as FRO, recommended removal from any command positions, and assessed a significant monetary penalty.
1. Landing at unpublished airstrips was the de facto standard of practice in the XXX Wing, and has repeatedly occurred without punishment before and since this incident. A subsequent policy letter (dated November 5, 1990) has been circulated specifically authorizing landings at private airstrips, so that RCC missions can be successfully completed.
In fact, on October 10, 1990, three CAP aircraft landed at a similar unapproved airstrip during mission XXX, and then embarked a non-member passenger. Both actions were without the prior approval of the Wing commander. Although the same regulations (plus others) were violated, no action has been taken against these aircrews.
appeal was filed with the Region commander within the time limit specified in the regulations. To date, the only response has been a minimal investigation by a region staff officer (Col XXX of XX). During conversations with this officer, it became clear that he was not familiar with either the facts of the case or the contents of the written appeal.
3. After waiting 11 months with no actions, a certified letter was sent to the XXX XXX requesting that the matter be transferred to another region for consideration and resolution because substantial prejudice existed against me. To date, there has been no response from the XXX XXX.
Many CAP regulations were blatantly ignored in order to pursue prejudicial treatment of my case. I have been denied due process, and no conclusion has been reached. Eleven months after the appeal was filed CAP management has not taken any meaningful steps to resolve the situation. Therefore, I respectfully request that you investigate this case.
